Legislative panic about deep fakes skips over NY for now, but changes to right of publicity could be coming soon

Check out my recent article on New York’s proposed Deep Fakes legislation in the August 2019 edition of Electronically In Touch, the official e-newsletter and blog of the Young Lawyers Section of the New York State Bar Association. The article takes a look at the legislation in New York to reassess the right of publicity in light of developments in deep fake technology. If passed, the bill would create civil liability for celebrity deep fakes and deep fake pornography.

Congress Considering Deep Fakes Law

Check out my contribution Congress Considering Deep Fakes Law on The Law Of Sex blog. The post takes a look at the recently introduced Defending Each and Every Person from False Appearances by Keeping Exploitation Subject to Accountability Act of 2019. If passed, the bill would create criminal penalties, civil liability, and a private right of action against those who fail to disclose or alter the disclosure on deep fakes.
